considerations and trial skills to win inmate medical neglect cases. These

Investigation:
• Presuit | This CLE will cover the
importance of obtaining all of the evidence you can presuit through data
practices requests. This includes incident reports, jail or prison video footage
and investigation reports.
• Who is at-fault? Correctional
staff or private medical provider and why does it
matter?
Lawsuit:
• Federal vs State Court | Which venue
should I choose for my lawsuit? What are the advantages and disadvantages of
each forum?
• Official Immunity vs. Qualified
Immunity
Discovery:
• How to establishing rule violations
by focusing on jail policies and procedures.
• How to effectively
depose correctional staff and medical experts.
Motion
Practice:
• Defeating the defenses of Official Immunity and Qualified
Immunity.
Trial
• How to successfully try
an inmate medical neglect case.
