In state criminal court, diversion
programs, Continuances for Dismissal (CFD), and Continuances Without Prosecution
(CWOP) are often good solutions to difficult charges for noncitizens in
particular. However, these solutions also present potential pitfalls that can
result in immigration consequences equal to an actual conviction. This CLE
reviews the good and bad of diversion and similar programs, and what to watch
for when considering them for an immigrant
client.
